Customs officials can stop trucks for inspection in 35 regions of the country

Parliamentarians have finalized a draft law passed by the state Duma in the first reading in April, on the ban on the turnover of certain categories of goods on the territory of Russia. We will remind, according to the deputies, this law will allow to protect Russia's economic interests and support of domestic producers in the framework of the trend of import substitution Counter-sanctions in the first place, will affect goods imported on customs rules, different from the established Eurasian economic Union. It is expected that after the law came into force, the government will be empowered to prohibit the circulation of certain categories of goods in the country. One of the main innovations introduced in the document in the second reading, is to expand the powers existing in some regions. They will be able to stop for inspection of the vehicle weight of 3.5 tons. This will allow to minimize the unauthorized entry of prohibited goods into the country. In accordance with applicable law, such actions post-control is possible, but only with the participation of the police Department and the traffic police. However, these agencies these tasks are not relevant.

Sergei Chizhov stressed that the rule on self-inspection of vehicles by the customs authorities will act only in areas "adjacent" to the state border – in the Altai, Dagestan, Ingushetia, North Ossetia, Astrakhan, Pskov, Samara, Bryansk and other areas – only 35 subjects. Their exhaustive list will be fixed by Federal legislation. In the rest of Russia, this form of control will be implemented according to the standard scheme within the framework of cooperation between the FCS and the interior and bodies authorized in the field of ensuring road safety. The MP said that this decision has already received preliminary approval by President Vladimir Putin.
Another important point, which drew the attention of Sergei Chizhov, is that inspection of vehicles will not be solid. When making decisions, employees of TCF will be guided or operational information, or the risk-oriented approach. The latter is already widely used in activities customs authorities and allows you more control in cases when the probability of crime is particularly high. Criteria customs officers in this work hold, of course, confidential and regulated by internal legal acts.

Ignorance is no excuse

An important amendment proposed to the bill in relation to categories of goods, the circulation of which may be banned. If the first version of the bill allowed the expansion of the categories now proposed to delete this provision and make the list closed. It can be included in the sanctioned products as well as goods, imported to the territory of the EAEU, on terms other than those installed by the common customs Union legislation.
The Government also stipulates an obligation to inform about the inclusion of "black list" of new product groups, however, with one caveat: if the exporter was not aware of the ban, he is not exempt from liability. This is due to the fact that the authors admit the emergence of "failures" in the process of information exchange between the customs authorities of the EEU, particularly in the early stages. Besides, Sergey Chizhov notes that even if we assume that the entrepreneur or organization-date information about the release of the goods was not reported, they always remain the right to demand information on their own.

We will remind, making comments on this decision of the representatives of the Voronezh customs said that from the economic point of view, the restriction of circulation of goods, which are provided by the bill will have a positive impact, for example, the development of agriculture in Russia. According to customs, the document is intended to bridge the gap in legal regulation of this issue and to help domestic producers to strengthen their positions in the market.
